Can my Employee have a can of OC spray for self-defence during the course of their employment?

Yes. Employers need to ensure they have all relevant information and protections in place for themselves and their employees. Read the Employer/employee fact sheet for more information.

I am a security guard or crowd controller, how does this affect me?

You are still able to have your OC spray openly displayed when being used for the purposes of your employment. For the period of the trial, there are now two options for how you/your employer can provide you with OC spray with a significant reduction in regulation. This does not diminish the reporting requirements that you are obligated to complete. Read the Security/Crowd Controller fact sheet for more information.

I’m an employer who does not want my employees carrying OC spray, what do I do?

We suggest that you define and communicate OC spray purchase, possession, carry and use as part of your internal business policies.

I’m an employee who wants to carry OC spray at work, what do I need to do?

Employees wanting to carry OC spray at work should discuss their intentions with their employer. Employers have been encouraged to establish workplace policies outlining their position on this.

Can I provide a canister of OC spray to my employees for their personal safety during their shift?

What do I need to do if I purchase OC spray on behalf of my employees?

You must complete an OC Spray Employer/Employee Declaration form and provide a signed, scanned copy of the declaration to OCSprayTrial@pfes.nt.gov.au within 2 business days after the supply of OC spray to an employee. You must also provide a copy to the employee so they can produce it if asked by a police officer. Read the Employer/employee fact sheet for more information.
