A 47-year-old male, off duty Police Officer who had been stopped by a police patrol before driving away as he was about to be requested to undertake a roadside breath test has been charged.

The officer was driving his own, private vehicle in a rural location at the time of the alleged offence on 5 February 2010.

He has been charged with:
Driving under the influence; and
Failing to comply with a police officers direction

He is due to appear in Darwin Magistrates Court on Friday 19 February 2010.
